Where a proposal fails to meet the guidance contained in the Technical Standards but the designer considers this can be achieved by an alternative method, we can consider such proposals through a process we term a Determination.
How to submit your application and how it is considered
- It is important that you discuss your proposals with us in advance to determine feasibility.
- Submit an Determination Application submission (PDF, 68 KB) which must be accompanied by sufficient supporting information to allow an informed decision to be made.
- We will then undertake consultation with other interested parties as deemed appropriate.
- We will then issue the decision notice. Note if a warrant has already been approved and the determination results in changes from the approved plans you will require to obtain an amendment of warrant.
Where a proposal fails to meet a Mandatory Building Regulation (they are highlighted in the Technical Handbooks)
In such circumstances the Local Authority cannot consider a request for an alternative solution, this requires to be subject of an application for relaxation.
A relaxation application can only be considered by the Building Standards Division of the Scottish Government.
