5. Use of the North Inch, Perth by British Military Fitness (BMF)
Since 2010, BMF have used the North Inch to provide military style fitness classes to members of the public. In 2011 a Minute of Agreement was entered into between Perth & Kinross Council and BMF for a trial period of 1 year to ascertain if the fitness classes were a success and to ensure that no adverse comments were received about the operation of these classes. A Minute of Agreement has been agreed on an annual basis.
In terms of Section 1 of the Land Reform (Scotland) Act 2003, the public have the right to be on access land for recreational purposes and these purposes include the carrying on, commercially or for profit, of an activity which the person exercising the right could carry on otherwise than commercially or for profit. The areas of the North Inch on which BMF will deliver their classes are considered to be "access land" for the purposes of the 2003 Act and BMF are therefore entitled in terms of the 2003 Act to use these areas of the North Inch for the purpose of delivering fitness classes.
BMF will not require to take vehicular access to the North Inch and will use no equipment in delivering their fitness classes.
The Committee is asked to note:
(i) the non-exclusive use of part of the North Inch Perth by BMF for their sessions involving members of the public
(ii) that a Minute of Agreement will be agreed to regulate the use and to ensure that the interests of the public are not affected.
